to the east bay where we spent part of the day monitoring bay area road at the command center of cal-trans. nick smith has more. >>reporter: excess run off from heavy rainfall creating big ponds in areas of downtown oakland. the intersection of third and washington street became a virtual lake with water so high it blocked parking spaces poured into one lane of traffic. with the sidewalk covered in rain run off this woman appeared to be baffled by how to get around i it. so she just stood there. ankle deep in rain water. freeway not much better. 8 80 at the marina boulevard exit was a wet gray mess. heavy rain obscured the view of drivers creating a constant wave of stop and go traffic and sea of brake lights. this accident was one of many we witnessed in the span of only 2 hours. low lying spots on the highway often flood quickly. increasing road hazard for drivers and new set of challenges for the crew assigned to keep the freeway and storm drains clear of all obstruction. >> we have to make sure that they are not being plugged by either mud or leaves or by litter. >>report

eric cal sw -- swalwell. michael montgomery, reporter for kqed and center for investigative reporting, and moore, professor of law. the u.s. supreme court convened today behind closed doors discussing whether or not to review a lower court ruling striking down california's proposition 8. their highly anticipated decision could come monday. as you well know, the supreme court gets seven to eight thousand requests for cases to be reviewed. how do they decide? they only pick 80 or so a year. what is the criteria and why would prop 8 be an important one to look at? >> it's how legal the precedent is and how national the question is, how many people it affects, and relatedly, how much lower courts are struggling over that and related questions. so in the prop 8 case, it's true the prop 8 is a california-specific measure, and it's also true that a ninth circuit ruling tried to make its ruling non-specific. california is such an important state and it occurs in dozens of other states and that's why it might have some appeal for the supreme court. >> as you said, the ninth circuit narrowed it

thor cal preservation commission and more scrutiny on historic buildings as to their preservation, as was the case before. * and given this scrutiny, which i think is good, we do want to preserve the past and preserve buildings from the past. we may have to allow in return for the preservation the owners of these buildings a little more flexibility in creating something that's economically feasible. otherwise, you have an older building that's in great disrepair, falling apart, a use that is not a credit to the neighborhood oftentimes and, you know, sometimes conditions in the case of housing that are not good ones for the residents there. so, i think -- i'm not saying wide open anything that's even vaguely eligible, but i think we have to kind of look at this carefully and see if there is something we could craft that would allow some flexibility in the various areas of zoning to allow something that's maybe legal but nonconforming to continue in this use in return for, you know, the restoration

sometimes it's easy to become kin cal there are still -- cynical there are people who give of themselves just out of the kindness of theirigihae heart, . and it pretty amazing. so today i'm taking the opportunity to recognize a team of people that have worked very diligently to improve the conditions of public housing. i think it is incredibly important to recognize those that fly under the radar, but do extraordinary work to serve the public. i would like to ask housing authority staff, and i'm glad you guys are up here now, marshall,v,'(⌞ç philip, pamela,d will staff person leland, and newly elected plaza east tenant association martha. over the past several months, i have worked closely with staff and residents of the housing authority sites that quee that e have in district 5, whether programming community spaces, or connecting folks to mental health services, the group here today has gone above and beyond to be community builders for the residents of public housing. most recently the staff teamed with good will to get residents involved in the intensive job readiness program and

in preparation for this. we did the fema online course, eoc course at nasne, hadr course, trained with cal fire, take the time to take that training. it's tough to fit it in but it's important to fit it in and it will make us more effective. we did an exercise back in may in preparation for this and developed a pretty detailed concept of operations. we built load plan, timelines, spare parts lists, we really got into the weeds, thinking about the second and third tier effects, so i want my relief to understand that and i want him to know where that plan is so he can pull it right off the shelf if this ever happens and be ready to respond quickly instead of trying to figure this all out when we need to be getting underway. >> i'll boil mine down into just one, and that is i will pass to my relief to continue to support events like this and look for opportunities to continue to learn how we best in the military can integrate with our civilian and federal contemporaries to be prepared for an eventuality that we hope will never come, but we certainly should be prepared for. so the one thing i'm p

got put through the metaphor cal meat grinder. it was horrible. falling from $17 to $4. as the company came into 2012 the ball was set very low. when the expectations are that low, even lousy results can take the stock hire as long as they aren't downright pitiful. last year sales nowhere near good. but in line with the street's expectations and not absolutely hard which was good enough to give the stock some lift at these levels. even though max has rallied this year, it climbed from $17. it still has a way to go before it's back to even. when you look at it in that context, this rally doesn't seem insane. office max has been trying to get its house in order. it announced it was reinstating its two cent per share quarterly dividend. not much. the stock yields about 1%. it also told us it was conducting a comprehensive capital allocation review. designed to simplify its balance sheet. a couple of important elements here. office max got caught up in the terrible lehman bankruptcy. they had bonds backed by lehman connected to timber assets. the courts resolved this in september. office m
